Traffic Tip Tuesday 03-01-2016
It is no secret that speeders on our roadways put the citizens of our county in danger. But did you know that Florida state law also recognizes the fact that drivers travelling too slow on our roadways can also cause a potential hazard to fellow motorists?
Florida State Statute 316.081 advises:
(1) Upon all roadways of sufficient width, a vehicle shall be driven upon the right half of the roadway, except as follows:
(a) When overtaking and passing another vehicle proceeding in the same direction under the rules governing such movement;
(2) Upon all roadways, any vehicle proceeding at less than the normal speed of traffic at the time and place and under the conditions then existing shall be driven in the right-hand lane then available for traffic or as close as practicable to the right-hand curb or edge of the roadway except when overtaking and passing another vehicle proceeding in the same direction or when preparing for a left turn at an intersection or into a private road or driveway.
What this means to you as a driver, is that a driver must occupy the right lane when available, and only utilize the left lane to overtake a slower moving vehicle. The left lane is not to be occupied unless overtaking another vehicle, even if you’re obeying the posted speed limit. Once a slower vehicle has been passed, it is a driver’s responsibility to return to the right lane as soon as safely feasible. Keep right unless to pass.
Please understand that this law in no way condones or authorizes speeding, however, it does define the proper procedure to maintain smooth traffic flow over our roadways, and to aid in the reduction of aggressive driving. Violators of this provision of law can be cited with a moving violation, and a fine of $164.00.
